TERMS & CONDITIONS
1. General
We are accessible through phone and email during business days from 9 AM to 6 PM. For contact information please see our contact page. The following sales, delivery and payment terms apply to all deliveries and services of Tony's Heartware. When products are ordered from Tony's Heartware, you agree to the provisions of these terms and conditions as a business and a shop.
2. Prices & Payment
The prices displayed in the web-store are quoted in Euros and include Dutch VAT (where applicable) at the current rate and exclude any delivery charges.
Tony’s Heartware reserve the right to amend prices at any time.
At Tony's Heartware you can choose from four secure payment methods processed by payment provider Mollie: Ideal, Bancontact, PayPal and Credit Card; Mastercard & VISA.
As soon as we have received your payment, we’ll start processing your order.
Should the occasion arise that the incorrect price for a product is displayed on the website due to a system glitch or human error, we reserve the right to cancel any orders made for products at the incorrect price and refund all monies that have been paid. We are not obliged to honour the incorrect price in any future orders. In the unlikely event that this should occur we will contact you to advise of this as soon as possible.
You must pay for the products (including any delivery costs) in full at the time you place your order.
Tony's Heartware strives to provide you with accurate shipping costs at the time you place your order. However, we do sell some large and heavy products that may require a more specialized delivery service than our normal delivery. After you have placed your order, we will contact you to inform you of any additional costs associated with the delivery before we proceed to process your order.
Ownership in the products we supply to you will not pass until we have received all sums due (including delivery charges).
3. Ordering
After an order has been placed, you will receive a confirmation email with the order summary and the total amount including shipping.
An order will only be shipped after payment has been received by Tony's Heartware.
Images and specifications are indicative. All products are handmade and can therefore vary slightly. If a product does not meet your expectations, you can return it, but it cannot give rise to a claim.
4. Delivery
Tony's Heartware delivers all packages with Post.nl and with Track & Trace
Tony's Heartware will send the order as quickly as possible after payment of the agreement. Tony's Heartwarealways strive to make sure you get your order in the estimated shipping time. If this is not possible, for whatever reason (because an article is temporarily out of stock or if post services are on a strike) you will be notified about this immediately.
Tony's Heartware is not liable for late delivery, loss or damage by Post.nl.
Up to and including the delivery Tony's Heartware bears the responsibility for the order.
After the delivery, the responsibility will be transferred to you.
5. International Orders
For customers purchasing from outside The Netherlands the shipping costs shown on the website and Order Confirmation are given as an estimate only. We endeavor to give the most accurate price, but due to variance in size and weight of our goods, shipping can incur additional charges.
If there is a difference in the shipping costs, Tony's Heartware will contact you by e-mail to advise you of the costs.
For customers purchasing goods to be shipped outside the EU, VAT will be deducted from the order at checkout, once you have filled in the billing information. Upon delivery to these countries you may be liable for import duty and local taxes on your order, which will need to be paid to the carrier or local tax office before they will release the goods.
Be aware of that !
6. Warranty
After the trial period of fourteen days, Tony's Heartware gives a two-month warranty on the quality of the product. If you are not satisfied with the quality of the product, please send us an email to info@tonysheartware.com
The Tony's Heartware fashion and home products are handmade and remain unique. It is therefore possible that the products differ slightly from the photos on the site.
The warranty will lapse if you have damaged or incorrectly treated the item yourself.
7. Returns
Tony’s Heartware wants you to be completely satisfied with your purchase and if for any reason the items you have ordered do not meet your expectations we will be happy for you to exchange these for another item of the same value or refund you in full.
You can return the item within 14 days of receipt of the order.
Returns are only accepted if they have been notified in advance by telephone or e-mail. You can use the Return form for your return shipment.
On the condition that the product is:
o unused and unwashed.
o not damaged.
o in its original packaging or any other solid carton box.
o securely taped.
Unfortunately, Tony’s Heartware cannot credit returns that do not meet these conditions.
The warranty lapses if the article has been damaged or if you have tried to repair the defect yourself.
You will be liable for the cost of returning the item. After approval of your return we will refund the amount within 10 working days.
Tony’s Heartware doesn’t return the shipping costs.
8. Privacy
Your personal data will be handled carefully and confidentially by Tony's Heartware and will only be made available to third parties in connection with payment transactions and delivery. For detailed information, read the Tony's Heartware privacy statement.
9. Intellectual Property & Right to Use
You acknowledge and agree that all copyrights and all other intellectual property rights in any material or content provided as part of the website remain with Tony's Heartware at all times. You may only use this material as expressly authorized by us Tony's Heartware.
Visitors to the site can in no way derive any rights from the information provided.

11. Law
The Terms are governed by and construed in accordance with the laws of The Netherlands and you irrevocably submit to the exclusive jurisdiction of the courts of The Netherland.
12. Entire Agreement
All users of this site are deemed to have taken note of and agree to the above conditions. By placing an order, you automatically agree to the above terms and conditions.
These conditions govern our relationship with you.
